Article 1: General provisions

The webshop of Construlux bv with registered office at 3580 Beringen, Zandstraat 105, VAT BE 0867.635.105, RPR Hasselt, (hereinafter “Construlux”) offers its customers the opportunity to purchase products from its webshop online. These General Terms and Conditions ("Terms") apply to every order placed by a visitor to this webshop (“Customer”). When placing an order via the webshop, the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions, to the exclusion of all other conditions.

 

Article 2: Price

All prices listed are in EURO, including VAT, excluding delivery costs. Prices are subject to change at all times.

Article 3: Offer and liability

Despite the fact that the online catalogue and the webshop are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Construlux. Construlux is only bound to a means obligation with regard to the correctness and completeness of the information provided. Construlux is in no way liable in the event of material errors, typographical errors or printing errors. If the Customer has specific questions about e.g. sizes, colour, smell, availability, delivery time or delivery method, we request the Customer to contact our customer service in advance via info@julien-deluxe.com . Construlux cannot be held liable for the unavailability or unavailability of a product. Construlux cannot be held liable for any damage resulting from allergic reactions as a result of the use of products supplied by Construlux, even if Construlux has been informed of this in the meantime.

Article 4: Online purchases: Order procedure and payment methods

To place his order, the Customer has the possibility to register and create an account, to log in with his existing account or to pay directly. The Customer can select an existing delivery address or enter a new address. The delivery address can be the same or different from the billing address. Shipping method: orders are delivered via BPost and DPD. Shipping costs per order: €7.00 incl. VAT for shipments within Belgium and €9 incl. VAT for shipments to the Netherlands. Free shipping for orders from €75 incl. VAT for shipments within Belgium. Free shipping for orders from €75 incl. VAT for shipments to the Netherlands and Germany . The Customer can choose between the following payment methods: by credit card, iDeal, Bancontact, Belfius, KBC and PayPal. After selecting the payment method and confirming the order, the Customer is redirected to the payment page. The Customer receives a confirmation email of his order. Construlux is entitled to refuse an order as a result of a serious shortcoming on the part of the Customer with regard to orders in which the Customer is involved.

Article 5: Alcoholic beverages

It is prohibited by Belgian law to sell spirits to people under the age of 18. In order to order alcoholic beverages, the Customer must be at least 18 years old. By ordering online, the buyer declares to be of legal age to purchase alcoholic beverages.

Article 6: Delivery and execution of the agreement

Ordered items will be delivered after payment of the full amount due, including shipping costs. Items ordered via this webshop will be delivered in Belgium, to the delivery address specified by the customer. Unless otherwise agreed or expressly stated otherwise, the goods will be delivered to the delivery address specified by the Customer within 10 days of receipt of the order. Delivery is made by BPost, PostNL or DPD. Shipping costs per order: €7.00 incl. VAT for Belgium, €9 to the Netherlands. Free shipping for orders over €75 incl. VAT (Belgium and the Netherlands). Construlux is never liable for any damage resulting from exceeding delivery times by Construlux itself or by the deliverer. Any visible damage and/or qualitative deficiency of an item or other deficiency in the delivery must be reported to Construlux by the Customer without delay. The risk of loss or damage is transferred to the Customer as soon as he (or a third party designated by him, who is not the carrier) has physically taken possession of the goods.

Article 7: Right of withdrawal

The Customer has the right to revoke the agreement within a period of 14 calendar days without giving any reason. The revocation period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, physically takes possession of the goods. In order to comply with the revocation period, the Customer must send his communication concerning his exercise of the right of revocation before the revocation period has expired. The Customer must return or hand over the goods to Construlux without delay, but in any case no later than 14 calendar days after the day on which he communicated his decision to revoke the agreement to Construlux. The Customer is on time if he returns the goods before the period of 14 calendar days has expired. In order to exercise the right of revocation, the Customer must Construlux, Zandstraat 105, 3580 Beringen, info@julien-deluxe.com , 011 / 35 13 91 by means of an unambiguous statement (e.g. in writing by post or e-mail) of his decision to revoke the agreement. Any additional costs resulting from the Customer's choice of a method of delivery other than the cheapest standard delivery offered by Construlux will not be reimbursed. If the returned product has been diminished in value in any way, Construlux reserves the right to hold the Customer liable and claim damages for any diminished value of the goods resulting from the Customer's use of the goods that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods. Only items that are in the original packaging, together with all accessories, instructions for use and invoice can be taken back. If the Customer revokes the agreement, Construlux will refund the payments received from the Customer, including the standard delivery costs if applicable, to the Customer within 14 days after he has received all the goods back. The costs of returning the item are borne by the Customer. Construlux will reimburse the Customer using the same means of payment as the Customer used for the initial transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not be charged any fees for such reimbursement. The Customer may not exercise the right of withdrawal for the delivery of sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery. Hair and beard care and styling products are products of this nature and may only be returned if they are unopened (so any packaging must also be intact) and the product must be unused.

Article 8: Warranty

Under the law of 21 September 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal guarantee applies from the date of delivery to the Customer. In order to invoke the guarantee, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods. For items purchased online and delivered to the Customer's home, the Customer must contact Construlux's customer service and return the item to Construlux at his own expense. If a defect is discovered, the Customer must inform Construlux as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months after it has been discovered. After that, any right to repair or replacement will lapse. The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, adjustments or modifications to the article, rough handling, poor maintenance, or any other abnormal or incorrect use. Defects that manifest themselves after a period of 6 months following the date of purchase, or delivery if applicable, are deemed not to be hidden defects, unless proven otherwise by the Customer.

Article 10: Affectation of validity - non-waiver

If any provision of these Terms is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions. Failure at any time by Construlux to enforce any of the rights stated in these Terms, or to exercise any right hereunder, will never be considered a waiver of such provision and will never affect the validity of these rights.

 

Article 11: Evidence

The administration of Construlux and of the delivery service shall, unless proven otherwise, be considered as evidence of the assignments and orders placed and payments made by the Customer to Construlux and of deliveries made by Construlux. The Customer accepts that electronic communications and backups may serve as evidence.

Article 12: Privacy Policy

The Customer can visit our webshop without having to provide personal data. Only if the Customer sends us an e-mail via the webshop or places an order on our webshop, he leaves his personal data with us. Otherwise it is of course difficult for us to answer the Customer's question or to deliver his order. If the Customer has any questions about the privacy policy of Construlux, the Customer can contact Linda Baute at the e-mail address: info@julien-deluxe.com . Construlux bvba is responsible for the processing of the Customer's personal data. Registered office: Zandstraat 105, 3580 Beringen; company number BE0867.635.108. Construlux undertakes to ensure the protection of personal data against destruction, loss, modification, access or misuse to the best of its ability through technical security regulations and an adequate security policy. Only Christophe De Gauquier and Linda Baute have access to your personal data. Our employees do not have access to the personal data provided to us via our webshop. The Customer has a legal right to inspect and possibly correct his personal data. Upon proof of identity (copy of identity card), the Customer can obtain written notification of his personal data free of charge via a written, dated and signed request to Construlux bvba, Zandstraat 105, 3580 Beringen, info@julien-deluxe.com . If necessary, the Customer can also request that data that is incorrect, incomplete or irrelevant be deleted or corrected. We will provide the Customer with an answer within 14 days. If the Customer does not receive the expected answer to his request, the Customer can file a complaint with the privacy commission via www.privacycommissie.be .

During his visit to the webshop, Construlux only receives personal data from the Customer if he sends us an e-mail or if he places an order.

If the Customer sends us an email via “Contact” on the webshop, we will receive his name and email address. Only Christophe De Gauquier and Linda Baute have access to this email. Our employees do not have access to this email. We will answer the email, but we will not do anything else with the email address and any other personal data that the Customer has provided to us via email. The data will not be included in a customer file. After we have answered the email, it will be deleted immediately. We do not use the data to resell or pass it on to third parties. If the Customer places an order with us via the webshop, we will only use his data for the execution of the concluded agreement, so to deliver the order and to create the invoice. For this we need the name and address of the Customer. We also ask for his email address so that we can send a confirmation email of the order and the payment. We use the Customer's telephone number in the event that we need to be able to reach the Customer due to ambiguities regarding the order. The Customer can create an account so that he does not have to re-enter his details every time. In the account we store the following information: name, address(es), telephone number, e-mail address, delivery and payment details. We also store details of previous orders of the Customer so that he can easily find them. The Customer is responsible for keeping his login details confidential and the use of his password. The password is stored encrypted. Construlux therefore does not have access to your password. The Customer can always change his details in his account. Our webshop is developed with software from Shopify. Shopify has access to your details to provide us with (technical) support, they will never use your details for any other purpose. We use the e-mail address to inform the Customer of promotions and campaigns. These e-mails always contain an unsubscribe link so that the Customer no longer receives these e-mails. We do not use the Customer's details to show him different prices than other customers. All our customers see the same price for the same product. We do not use the details to sell to third parties. We also do not pass on the data to third parties, unless to process the order. To follow up the payment, we use the services of Shopify Payments. After the Customer has paid, we receive an e-mail from Shopify containing the name, payment date, amount and an internal order number. After receiving this e-mail, we will send the order. To deliver the order, we use the services of BPost and DPD. To create the shipping label, we have an account on www.bpost.be and on www.DPD.com in which we store the name and address of the Customer in an address file. This way, we do not have to enter all the data again each time. BPost and DPD may only use the personal data provided for the execution of their specific assignment and may not use it for other purposes. In order to meet our accounting and fiscal obligations, the invoice with the Customer's data is also passed on to our accountant Stuyts Accounting Services, Koningin Astridlaan 2/A, 8200 Brugge. The categories of personal data concerned will be retained for a maximum of 14 days following the Customer's request to delete his personal data.

Article 13: Cookie Policy

During a visit to the site, 'cookies' may be placed on the hard drive of the Customer's computer. A cookie is a text file that is placed by the server of a website in the browser of your computer or on your mobile device when the Customer consults a website. Cookies cannot be used to identify people, a cookie can only identify a machine. 'First party cookies' are technical cookies that are used by the visited site itself and that are intended to allow the site to function optimally. For example: settings that the Customer has made during previous visits to the site, or: a pre-filled form with data that the user has made during previous visits. In addition, there are 'Third Party cookies'. These are cookies that do not originate from the website itself, but from third parties, e.g. an existing marketing or advertising plug-in, such as cookies from Facebook or Google Analytics. The Customer can set his internet browser in such a way that the First party cookies are not accepted, that he receives a warning when a cookie is installed or that the cookies are subsequently removed from his hard drive. He can do this via the settings of his browser (via the help function). Please note that certain graphic elements may not appear correctly, or that certain applications cannot be used.

Article 14: Changes to conditions

Construlux has the right to change these conditions and the content of the webshop at any time.

Article 15: Applicable law - Competent court

Belgian law applies. All disputes between parties will be submitted exclusively to the competent court.
